DATA PROTECTION & PRIVACY NOTICE
For Users of The Training Exchange
Westlake Corporation (“Westlake”), located at 2801 Post Oak Boulevard, Suite 600, Houston, Texas 77056, and its subsidiaries around the world operate within a matrix organization in which employees of the different Westlake companies are required to exchange information, and in particular, with the group parent company Westlake Corporation in the USA. One of the purposes of this exchange of information with Westlake is to engage employees in group-wide personnel training and development vis-à-vis The Training Exchange (“TTX”), a web-based training platform.
The protection of individuals’ personal information is important to Westlake. This Data Protection and Privacy Notice (“Notice”) describes how Westlake handles personal information that is subject to the applicable data privacy laws where Westlake does business, including the EU General Data Protection Regulation and associated national laws, the Act on the Protection of Personal Information of Japan (Act. No. 57 of 30 May 2003), Taiwan’s Personal Information Protection Act, Vietnam’s Law on Cyber Information Security, Mexico’s Federal Law on Protection of Personal Data held by Private Parties, Alberta’s Personal Information Protection Act, British Columbia’s Personal Information Protection Act, Quebec’s Act Respecting the Protection of Personal Information in the Private Sector, and other applicable laws.
In this notice, “you” and “your” refers to the employees of the various subsidiaries of Westlake Corporation.
I. Who will acquire and process my personal information?
Westlake will acquire and process your personal information, which is provided to Westlake by its subsidiary that is your legal employer.
Westlake is the “Data Controller” of the personal information stored in the Training Exchange. Stated another way, Westlake is the business operator responsible for the management of the personal information in The Training Exchange. The subsidiary that is your employer or another Westlake subsidiary, as a “Joint User” or a “Joint Controller,” will also acquire and process personal information from The Training Exchange if Westlake shares your personal information with that subsidiary or when such subsidiary is involved in initiating, requesting, or coordinating the training with Westlake. As Joint Controllers, Westlake and the relevant subsidiary are responsible for deciding how to hold and use personal information available in The Training Exchange.
The purposes for which the Joint Users or Joint Controllers acquire and process personal information are described in Section V below. Information about where these Joint Users or Joint Controllers are located is in Section II.
II. Where are the Joint Users or the Data Controllers located?
As explained above, Westlake and the relevant subsidiary who employs you or who is responsible for initiating, requesting, or coordinating the training are Joint Users or Joint Controllers. The relevant entities who may acquire and process the data jointly with Westlake and their addresses are:

III. What personal information is being processed?
The following personal information will be processed in The Training Exchange for the purposes of administering online training:
Employment Information: This includes information about your employment with the relevant subsidiary, including hire date, active or leave status, email, employment status, job classification, position, department, business unit, supervisor name and position, work location and address, time in position, and the entity that is your employer.
Learning Information: This includes information about the training subjects that interest you, the training courses assigned to you, the dates and times you complete training, the status of completion of your training, your time zone, whether you are a “creator” or “follower” of a training playlist prepared in the platform, the training selections recommended for you by the platform, your preferred language, and your training transcript.
HTTP Information: This includes the IP address and domain name from which you access the training tool, the website (referrer URL) that you accessed before visiting The Training Exchange website, the type and version of the web browser, and any search terms you have entered on the website or referral website.
Security Information: This includes your username, password, security questions, and answers to security questions.
If we are unable to collect this information, we may be unable to deliver training content to you and provide technical support.
IV. For what purposes are my personal information being processed?
Westlake and the subsidiary that is your employer will acquire and process all of the personal information identified above only to the extent necessary for the following purposes:
(a) Delivery of Online Training: Westlake and your employer entity may use Employment Information and Learning Information to deliver online training content to you and to administer group or individual training programs.
(b) Internal Reporting: Westlake and your employer entity may use Employment Information and Learning Information to generate reports on the status of the training content delivered to employees, such as who requires or has completed training, and to document an employee’s training history.
(c) Technical Support: HTTP Information and Security Information may be used by the provider of The Training Exchange to help diagnose application or server issues and to administer the training platform. Such information may also be used to gather broad demographic information, such as country of origin and internet service provider.
V. How long do you store my personal information?
The personal information in the Training Exchange will be stored for as long as it is necessary to achieve the purposes set forth above or as long as it is necessary to comply with any legal reporting or retention requirements.
VI. What makes it necessary for us to acquire and process personal information?
The processing for the purposes identified in Section V above (1) is necessary for compliance with legal obligations specifically concerning any aspect of the employment relationship or to comply with legislation on social security, hygiene, occupational safety, environmental, tax, union rights, the employment relationship, health protection, order and public safety, and United States securities law to which Westlake and its subsidiaries are subject; and (2) is necessary for Westlake’s and its subsidiaries’ legitimate interests to train personnel on pertinent company policies and legal regulations applicable to employees.
VII. Who will receive my personal information?
1. Cornerstone as a processor
The personal information you provide will be stored in a database which is located on servers in the USA, hosted by Cornerstone OnDemand Inc. Cornerstone OnDemand Inc., whose address is 115 Perimeter Center Place, Suite 460, Atlanta, Georgia 30346, is the data processor of the personal information in The Training Exchange, and it has entered into contractual commitments with Westlake to secure the information you provide in accordance with applicable law and to ensure that it processes personal information in The Training Exchange only on our behalf, subject to our instructions. Cornerstone is committed to maintaining stringent privacy and security practices including those related to notice, consent, transfer of personal information, security, data integrity, access, and enforcement. If pertinent to perform a contractual obligation to Westlake, select members of Cornerstone’s Information Technologies staff may receive personal information in The Training Exchange to enable them to perform critical database support for this online application.
2. Other Parties
Relevant personnel of Westlake and, if applicable, of the relevant Joint Users or Joint Controllers, (see Sections I and
II above), including members of management, representatives of Human Resources, Health, Safety & Environmental, Information Technology (IT), the Legal Department, and Westlake’s or its subsidiaries’ external legal advisors may also receive personal information located in The Training Exchange. These individuals may be located in the United States or elsewhere, as indicated in Section II above. See Section VIII for further information about these data transfers.When delivering training, this is initially only handled by Westlake Corporation, the Westlake entity responsible for initiating, requesting, or coordinating the training, and the entity that employs you. Only where the involvement of other parties is necessary to obtain legal advice, assert a claim or defense in legal proceedings, comply with a legal obligation, respond to a request for disclosure from a government authority, Westlake discloses the information to the relevant parties.
VIII. Where do you transfer my personal information?
Cornerstone will manage and process personal information in The Training Exchange in the USA. Where it is necessary for Westlake to fulfill any of the purposes described in Section V, your personal information will be transferred to relevant personnel of Westlake’s U.S.-based subsidiary, Westlake Management Services, Inc., relevant personnel employed at the Westlake subsidiary responsible for initiating, requesting, or coordinating the training, or relevant personnel employed at the Westlake subsidiary that employs you, to the extent permitted under applicable laws. Because these other countries may not provide an adequate level of protection for your personal information, we will provide appropriate safeguards and an adequate level of protection as required by applicable law for your personal information. Transfers between Westlake and its subsidiaries will occur subject to the entry of appropriate data sharing agreements, including based on the EU standard contractual clauses, where applicable.
You have a right to obtain details of the mechanism under which your personal information is transferred outside of the country where you are located by contacting privacy@westlake.com.
IX. Is my personal information being protected?
Westlake and any applicable Joint User or Joint Controller will take necessary and reasonable safety measures to prevent your personal information from being stolen, altered, damaged, destroyed, or disclosed.
X. What are my rights?
Your data will be processed lawfully, fairly and in a transparent manner. Subject to our obligation under applicable law, you may exercise the following rights:
Right of Access: You have a right to obtain confirmation from us as to whether or not your personal information is being processed, or, in certain jurisdictions, you may request to make duplications of such personal information. If your personal information is being processed, you have the right to access the personal information and receive certain information, such as the purposes of the processing, the categories of the personal information concerned, and the recipients to whom the personal information has been or will be disclosed.
Right to Correction (Rectification): If the personal information we hold about you is inaccurate or incomplete, you have the right to have it corrected. If you are entitled to have information corrected and if we have shared your personal information with others, we will let them know about the rectification where possible. If you ask us, we will also tell you, where possible and lawful to do so, with whom we have shared your personal information so that you can contact them directly.
Right to Erasure: You have the right to obtain from us the erasure of your personal information without undue delay in certain circumstances, such as where we no longer need the personal information for the purposes for which it was processed or collected, or if you withdraw consent and there is no other legal ground for the processing. The right to erasure will not apply if the processing is necessary for certain reasons, such as if the processing is necessary for compliance with a legal obligation or for the establishment, exercise or defense of legal claims. If you are entitled to erasure and if we have shared your personal information with others, we will let them know about the erasure where possible. If you ask us, we will also tell you, where it is possible and lawful for us to do so, with whom we have shared your personal information with so that you can contact them directly.
Right to Restrict Processing: You can ask us to restrict the processing of your personal information in certain circumstances, such as where you contest the accuracy of that personal information. Restriction means that your stored personal information cannot be used for future processing. If you are entitled to restriction, your personal information will only be processed with your consent or for the establishment, exercise or defense of legal claims, or for the protection of the rights of another person, or for reasons of important public interest related to the applicable jurisdiction. If you have obtained restriction of processing, we shall inform you before the restriction of processing is lifted, and the restriction will last for a period that enables us to verify the accuracy of the personal information. If you are entitled to restriction and if we have shared your personal information with others, we will let them know about the restriction where possible. If you ask us, we will also tell you, where it is possible and lawful for us to do so, with whom we have shared your personal information with so that you can contact them directly.
Right to Object to the Processing and Limit the Use and Disclosure of your Data (in certain jurisdictions): You have the right to oppose to the processing of your personal information for secondary purposes or based on other legitimate grounds. You may also ask us to limit the use and disclosure of your personal information.
Right to Data Portability: You have the right, in certain circumstances, to receive a copy of personal information we have obtained from you in a structured, commonly used and machine readable format, and to reuse it elsewhere or to ask us to transfer it to a third party of your choice.
Abstention from Automated Decision-Making and Profiling: You have the right not to be subject to a decision when it is based on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us. We do not intend to use automated decision-making with regard to the handling of your Report.
Right to Withdraw Consent: If we rely on your consent (or explicit consent) as our legal basis for processing your personal information, you have the right to withdraw that consent at any time subject to applicable law.
Right to Lodge Complaint with a Supervisory Authority: If you have a concern about any aspect of our privacy practices, including the way we have handled your personal information, you can report it to the relevant supervisory authority. A list of each supervisory authority may be found at the website of the German Federal Commissioner for Data Protection and Freedom of Information: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html.
Please note that some of these rights may be limited where we have an overriding legitimate interest or legal obligation to continue to process the personal information, or where the personal information may be exempt from disclosure due to applicable law. (For persons located in the EU, you may find more information about your rights as a data subject and on any restrictions of these rights in Art. 7 (3), Art. 12, 15 – 23 and Art. 77 of the GDPR.)
You are also entitled to send us specific instructions regarding the use of your personal information after your death.

We may amend this Notice from time to time. We will notify you of any material changes by posting the updated version in The Training Exchange application. We encourage you to review this Notice periodically to be informed of any changes on how we process your personal information when you use this system.

Die Westlake Corporation („Westlake“) mit Geschäftssitz in 2801 Post Oak Boulevard, Suite 600, Houston, Texas 77056, USA, und ihre Tochtergesellschaften in aller Welt arbeiten innerhalb einer Matrixorganisation, in der die Mitarbeiter der verschiedenen Westlake-Gesellschaften, insbesondere mit der Muttergesellschaft Westlake Corporation in den USA, Informationen auszutauschen haben. Mit diesem Austausch bezweckt Westlake unter anderem eine Einbindung der Belegschaft in weltweite Schulung und Weiterbildung über die Training Exchange („TTX“), eine internetbasierte Schulungsplattform.
Westlake legt großen Wert auf den Schutz der personenbezogenen Daten. Diese Datenschutzmitteilung („Mitteilung“) wurde erstellt, um darüber zu informieren, wie Westlake mit personenbezogenen Daten umgeht, die den örtlichen Datenschutzgesetzen an den Arbeitsstätten von Westlake unterliegen, darunter den Allgemeinen Datenschutzbestimmungen der EU und damit assoziierten Landesgesetzen, dem Gesetz Japans zum Schutz personenbezogener Informationen (Gesetz Nr. 57 vom 30. In dieser Mitteilung beziehen sich „Sie“ und „Ihnen“ auf die Mitarbeiter der verschiedenen Tochtergesellschaften der Westlake Corporation.
I. Wer erfasst und verarbeitet meine personenbezogenen Daten?
Westlake erfasst und verarbeitet diejenigen Ihrer personenbezogenen Daten, die Westlake durch die Tochtergesellschaft, die Ihr rechtlicher Arbeitgeber ist, bereitgestellt werden.
Westlake ist der „Datenverantwortliche“ für die im Training Exchange gespeicherten personenbezogenen Daten. Oder anders ausgedrückt: Westlake ist der wirtschaftliche Betreiber, der für die Verwaltung der personenbezogenen Daten im Training Exchange zuständig ist. Die Sie beschäftigende Tochtergesellschaft oder eine andere Tochtergesellschaft von Westlake erhalten als „gemeinsamer Nutzer“ oder „gemeinsamer Datenverantwortliche“ personenbezogene Daten von der Training Exchange, wenn Westlake Ihre personenbezogenen Daten mit dieser Tochtergesellschaft teilt oder diese Tochtergesellschaft an der Anregung, dem Ersuchen um oder der Koordination der Schulung gemeinsam mit Westlake beteiligt ist. Als gemeinsame Datenverantwortliche sind Westlake und die Tochtergesellschaft für die Aufbewahrung und Nutzung der in Training Exchange gespeicherten personenbezogenen Daten verantwortlich.
Die Zwecke, zu denen die gemeinsamen Nutzer personenbezogene Daten erfassen und verarbeiten, sind in Abschnitt V unten beschrieben. Angaben zu den Standorten dieser gemeinsamen Nutzer befinden sich in Abschnitt II.
II. Wo befinden sich die gemeinsamen Nutzer oder gemeinsamen Datenschutzbeauftragten?
Wie oben beschrieben sind Westlake und Sie beschäftigende Tochtergesellschaft oder diejenige Tochtergesellschaft, die für die Anregung, Beantragung oder Koordination der Schulungen zuständig ist, die gemeinsamen Nutzer oder gemeinsamen Datenverantwortlichen. Die jeweiligen rechtlichen Körperschaften, die Daten gemeinsam mit Westlake verarbeiten können, sowie deren Adressen sind:

III. Welche personenbezogenen Daten werden verarbeitet?
In der Training Exchange werden die folgenden personenbezogenen Daten für den Zweck des Anbietens der Online-Schulungen verarbeitet:
Angaben zur Beschäftigung: Darunter fallen Angaben zu Ihrer Anstellung bei der jeweiligen Tochtergesellschaft, einschließlich Eintrittsdatum, die Angabe, ob Sie gerade aktiv oder freigestellt sind, E-Mail-Adresse, Beschäftigungsstatus, Stellenbezeichnung, Position, Abteilung, Geschäftsbereich, Name und Position Ihres Vorgesetzten, Arbeitsort und -adresse, die Angabe, wie lange Sie Ihre Position bereits innehaben, und welche der Körperschaften Ihr Arbeitgeber ist.
Angaben zum Schulungsinhalt: Darunter fallen Angaben zu den Schulungsinhalten, für die Sie sich interessieren, die Ihnen zugewiesenen Schulungen, Daten und Zeitpunkte, zu denen Sie Schulungen abgeschlossen haben, Abschlussstatus Ihrer Schulungen, die Zeitzone, in der Sie sich befinden, ob Sie ein „Autor“ oder „Follower“ von Schulungslisten innerhalb der Plattform sind, die von der Plattform für Sie zusammengestellten Schulungsempfehlungen, Ihre Spracheinstellungen und Zeugnisse für Ihre Schulungen.
HTTP Angaben: Darunter fallen die IP-Adresse und Domainnamen des Terminals, von dem aus Sie auf die Schulungswebseite zugreifen, die Internetseite, von der aus Sie auf die Internetseite von Training Exchange gelangen (Referrer URL), Art und Version des von Ihnen genutzten Browsers sowie Suchbegriffe, die Sie auf der Internetseite oder der Referrer-Seite eingegeben haben.
Sicherheitsrelevante Angaben: Darunter fallen Ihr Benutzername, Passwort, Sicherheitsfragen und die dazugehörigen Antworten.
Sollten wir nicht in der Lage sein, diese Angaben zu erfassen, können wir Ihnen u.U. die Schulungsinhalte nicht bereitstellen und auch keinen technischen Support leisten.
IV. Zu welchen Zwecken werden meine personenbezogenen Daten verarbeitet?
Westlake und die Sie beschäftigende Tochtergesellschaft sammeln und verarbeiten alle oben genannten personenbezogenen, freiwillig bereitgestellten Daten nur im erforderlichen Umfang für die folgenden Zwecke:
(a) Anbieten der Online-Schulungen: Westlake und die Sie beschäftigende Tochtergesellschaft können die Angaben zu Ihrer Beschäftigung und zum Schulungsinhalt für die Bereitstellung von Lerninhalten Ihnen gegenüber sowie für das Abhalten von Gruppen- oder Einzelschulungen nutzen.
(b) Interne Berichterstattung: Westlake und die Sie beschäftigende Tochtergesellschaft können die Angaben zu Ihrer Beschäftigung und zum Schulungsinhalt zur Erstellung von Berichten zu den den Beschäftigten angebotenen Schulungsinhalten nutzen, zum Beispiel dazu, wer Schulungen angefordert oder abgeschlossen hat, und um die Schulungshistorie eines Mitarbeiters zu dokumentieren.
(c) Technischer Support: HTTP- und sicherheitsrelevante Angaben können vom Anbieter der Training Exchange zur Diagnose von Anwendungs- oder Serverproblemen herangezogen werden und erlauben das Anbieten der Schulungsplattform. Außerdem können mittels dieser Angaben auch weitergehende demographische Informationen gesammelt werden, zum Beispiel zum Herkunftsland und Internetdienstleister.
V. Wie lange speichern Sie meine personenbezogenen Daten?
Die personenbezogenen Daten im Training Exchange werden so lange gespeichert, wie dies zum Erreichen der oben genannten Zwecke oder zur Einhaltung gesetzlicher Melde- oder Aufbewahrungspflichten erforderlich ist.
VI. Warum ist es notwendig, dass wir personenbezogene Daten erheben und verarbeiten?
Eine Verarbeitung für die in Abschnitt V oben genannten Zwecke ist notwendig, (1) damit wir rechtliche Pflichten, insbesondere im Bereich Arbeitsrecht, erfüllen können sowie um den rechtlichen Anforderungen zu sozialer Absicherung, Hygiene, Arbeits- und Umweltsicherheit, Steuern, Gewerkschaftsrechte, Beschäftigungsverhältnis, Gesundheitsschutz sowie Ordnung und öffentliche Sicherheit, wie sie sich in den für Westlake und deren Tochtergesellschaft anwendbaren US-Gesetze finden, einzuhalten, sowie (2) um die rechtmäßigen Interessen von Westlake und deren Tochtergesellschaften an einer Schulung ihrer Mitarbeiter im Zusammenhang mit entsprechenden Unternehmensrichtlinien und den für die Mitarbeiter geltenden rechtlichen Vorschriften durchzusetzen.
VII. Wer erhält meine personenbezogenen Daten?
1. Cornerstone als Auftragsverarbeiter
Die von Ihnen bereitgestellten personenbezogenen Daten werden in einer Datenbank gespeichert, die sich auf von Cornerstone OnDemand Inc. gehosteten Servern in den USA befindet. Cornerstone OnDemand Inc. mit Hauptsitz in 115 Perimeter Center Place, Suite 460, Atlanta, Georgia 30346, USA, ist der Datenverarbeiter der personenbezogenen Daten in der Training Exchange. Cornerstone OnDemand Inc. ist mit Westlake vertragliche Verpflichtungen zur Sicherstellung der von Ihnen angegebenen Informationen gemäß anwendbarem Recht eingegangen und stellt sicher, dass es die personenbezogenen Daten in der Training Exchange nur in unserem Auftrag und laut unseren Anweisungen verarbeitet. Cornerstone verpflichtet sich zur Einhaltung strenger Datenschutz- und Sicherheitspraktiken, die sich unter anderem auf Mitteilungs- und Einwilligungsverfahren, die Übermittlung personenbezogener Informationen, die Sicherheit, Datenintegrität, den Zugang und die Durchsetzung beziehen. Falls zur Erfüllung einer vertraglichen Verpflichtung gegenüber Westlake relevant, erhalten ausgewählte IT-Mitarbeiter von Cornerstone ggf. personenbezogene Daten aus der Training Exchange, damit sie wichtige Datenbankarbeiten für diese Online-Anwendung durchführen können.
2. Sonstige Parteien
Relevantes Personal von Westlake und, falls zutreffend, die jeweiligen gemeinsamen Nutzer oder gemeinsamen Datenschutzbeauftragten (siehe Abschnitte {1} und {2} oben) sowie die Mitarbeiter der Geschäftsleitung, Vertreter der Bereiche Personal, Arbeits- und Umweltschutz, Informationstechnologie (IT), Rechtsabteilung und die externen Rechtsberater von Westlake oder deren Tochtergesellschaften erhalten möglicherweise auch personenbezogene Daten, die in der Training Exchange enthalten sind. Diese Rechtspersonen können sich in den USA oder auch, wie in Abschnitt II oben dargelegt, anderswo befinden. Siehe Abschnitt VIII für weitere Angaben zu dieser Datenübermittlung.
Schulungen werden zunächst grundsätzlich über Westlake Corporation angeboten, also der Westlake-Körperschaft, die für die Anbahnung, Beantragung und Koordination von Schulungen zuständig ist, und erst nachrangig über die Körperschaft, bei der Sie angestellt sind. Nur falls eine Beiziehung anderen Parteien notwendig ist, um rechtliche Hilfestellung zu erhalten, einen Anspruch geltend zu machen oder zur Verteidigung in gerichtlichen Verfahren, zur Erfüllung einer gesetzlichen Pflicht oder der Beantwortung einer Offenlegungsanfrage einer Regierungsbehörde wird Westlake Daten an die jeweilige Partei herausgeben.
VIII. Wohin übermitteln Sie meine personenbezogenen Daten?
Cornerstone verwaltet und verarbeitet personenbezogene Daten in der Training Exchange in den USA. Wann immer es für die Zwecke laut Abschnitt V für Westlake notwendig wird, werden Ihre personenbezogenen Daten an zuständige Mitarbeiter der in den USA befindlichen Westlake Tochtergesellschaft Westlake Management Services, Inc., der Westlake-Körperschaft, die für die Anbahnung, Beantragung und Koordination von Schulungen zuständig ist, oder auch der Sie beschäftigenden Westlake-Tochtergesellschaft weitergegeben, soweit nach geltendem Recht gestattet. Da diese andere Länder möglicherweise keinen angemessenen Schutz Ihrer personenbezogenen Daten bieten, stellen wir für Ihre personenbezogenen Daten gemäß den Vorschriften des anwendbaren Rechts angemessene Schutzmaßnahmen und ein ausreichendes Schutzniveau bereit. Eine Übermittlung zwischen Westlake und ihren Niederlassungen erfolgt unter dem Vorbehalt geeigneter Vereinbarungen zur gemeinsamen Datennutzung sowie, falls zutreffend, auf Grundlage der EU-Standardvertragsklauseln.
Sie haben das Recht, Einzelheiten zu den Vorgängen zu erhalten, über die Ihre personenbezogenen Informationen außerhalb des Landes übermittelt werden, in dem Sie sich befinden. Wenden Sie sich dazu an privacy@westlake.com.
IX. Werden meine personenbezogenen Informationen geschützt?
Westlake und etwaige gemeinsame Nutzer oder gemeinsame Datenschutzbeauftragte unternehmen notwendige und angemessene Sicherheitsmaßnahmen zum Schutz Ihrer personenbezogenen Informationen vor Diebstahl, Modifizierung, Beschädigung, Zerstörung oder Offenlegung.
X. Welche Rechte habe ich?
Ihre Daten werden rechtmäßig, fair und auf transparente Weise verarbeitet. Vorbehaltlich unserer im gesetzlichen Rahmen geltenden Verpflichtungen können Sie die folgenden Rechte ausüben:
Auskunftsrecht: Sie haben das Recht, von uns eine Bestätigung zu erhalten, ob Ihre personenbezogenen Informationen zurzeit verarbeitet werden. In bestimmten Gerichtsbarkeiten können Sie auch Kopien dieser personenbezogenen Informationen verlangen. Wenn Ihre Informationen verarbeitet werden, haben Sie das Recht, auf die personenbezogenen Informationen zuzugreifen und bestimmte Informationen zu erhalten, z. B. den Zweck der Verarbeitung, die Kategorien der betreffenden personenbezogenen Informationen und die Empfänger, denen die personenbezogenen Informationen offengelegt wurden oder werden.
Recht auf Korrektur (Berichtigung): Falls die bei uns über Sie vorliegenden personenbezogenen Informationen unrichtig oder unvollständig sind, haben Sie das Recht auf Korrektur. Falls Sie das Recht auf die Berichtigung von Informationen haben und wir Ihre personenbezogenen Informationen an andere weitergeleitet haben, werden wir diese, wenn möglich, über die Berichtigung in Kenntnis setzen. Falls möglich und gesetzlich zulässig, teilen wir Ihnen auf Anfrage auch mit, an wen wir Ihre personenbezogenen Informationen weitergeleitet haben, damit Sie direkten Kontakt dorthin aufnehmen können.
Recht auf Löschung: Sie haben das Recht, unter bestimmten Umständen unverzüglich die Löschung Ihrer personenbezogenen Informationen von uns zu verlangen, beispielsweise, wenn wir die personenbezogenen Informationen nicht mehr für die Zwecke benötigen, für die sie verarbeitet oder erfasst wurden, oder wenn Sie Ihre Einwilligung widerrufen und keine sonstige Rechtsgrundlage für die Verarbeitung besteht. Recht auf Einschränkung der Verarbeitung: Unter bestimmten Umständen können Sie uns auffordern, die Verarbeitung Ihrer personenbezogenen Informationen einzuschränken, z. Đối với Westlake, việc bảo vệ thông tin cá nhân là rất quan trọng. Thông báo về bảo vệ dữ liệu và quyền riêng tư (“Thông báo”) này mô tả cách Westlake xử lý thông tin cá nhân tuân theo luật pháp hiện hành về quyền riêng tư của dữ liệu tại những nơi Westlake kinh doanh, bao gồm cả Quy định chung về bảo vệ dữ liệu của Liên minh Châu Âu và luật pháp của các quốc gia liên quan, Đạo luật bảo vệ thông tin cá nhân của Nhật Bản (Đạo luật số 57 ban hành ngày 30 tháng 5 năm 2003), Đạo luật bảo vệ thông tin cá nhân của Đài Loan, Luật về an ninh mạng của Việt Nam, Luật liên bang về việc bảo vệ dữ liệu cá nhân do các Bên tư nhân lưu giữ của Mexico, Đạo luật bảo vệ thông tin cá nhân của Alberta, Đạo luật bảo vệ thông tin cá nhân của British Columbia, Đạo luật tôn trọng việc bảo vệ thông tin cá nhân trong khu vực tư nhân của Quebec và các bộ luật hiện hành khác.
Trong thông báo này, “bạn” và “của bạn” đề cập đến nhân viên của các công ty con khác nhau thuộc Westlake Corporation.
I. Ai sẽ tiếp nhận và xử lý thông tin cá nhân của tôi?
Westlake sẽ thu thập và xử lý thông tin cá nhân của bạn được công ty con của Westlake, chủ sở hữu lao động hợp pháp của bạn cung cấp cho Westlake.
Westlake là “Đơn vị kiểm soát dữ liệu” đối với thông tin cá nhân được lưu trữ trong The Training Exchange. Nói theo cách khác, Westlake là đơn vị kinh doanh chịu trách nhiệm quản lý thông tin cá nhân trên The Training Exchange. Công ty con là chủ sử dụng lao động của bạn hoặc một công ty con khác của Westlake, có vai trò là “Người dùng liên kết” hoặc “Đơn vị kiểm soát liên kết”, cũng sẽ thu thập và xử lý thông tin cá nhân từ The Training Exchange nếu Westlake chia sẻ thông tin cá nhân với công ty con đó hoặc khi công ty con đó tham gia vào việc khởi tạo, yêu cầu hoặc điều phối khóa đào tạo với Westlake. Mục đích Người dùng liên kết hoặc Đơn vị kiểm soát liên kết thu thập và xử lý thông tin cá nhân được mô tả trong Phần V dưới đây. Thông tin về địa chỉ của những Người dùng liên kết hoặc Đơn vị kiểm soát liên kết này được nêu trong Phần II.
II. Địa chỉ của Người dùng liên kết hoặc Đơn vị kiểm soát dữ liệu?

III. Những thông tin cá nhân nào sẽ được xử lý?
Thông tin cá nhân sau đây sẽ được xử lý trong The Training Exchange cho mục đích quản lý khóa đào tạo trực tuyến:
Thông tin về công việc: Đây là thông tin về công việc của bạn với công ty con liên quan, bao gồm ngày tuyển dụng, tình trạng làm việc hoặc nghỉ việc, email, tình trạng việc làm, phân loại công việc, vị trí, phòng ban, đơn vị kinh doanh, tên và chức vụ của giám sát viên, địa điểm và địa chỉ làm việc, thời gian đảm nhận chức vụ và thực thể là chủ sử dụng lao động của bạn.
Thông tin về học tập: Đây là thông tin về chủ đề đào tạo mà bạn quan tâm, khóa học được chỉ định cho bạn, ngày và thời gian bạn hoàn thành khóa đào tạo, trạng thái hoàn thành khóa đào tạo, múi giờ, liệu bạn là “người tạo nội dung” hay “người theo dõi” của danh sách phát khóa đào tạo được chuẩn bị trên nền tảng, các lựa chọn đào tạo được nền tảng đề xuất cho bạn, ngôn ngữ ưa thích của bạn và bản ghi của khóa đào tạo.
Thông tin về HTTP: Thông tin này bao gồm địa chỉ IP và tên miền mà bạn dùng để truy cập công cụ đào tạo, trang web (URL liên kết) mà bạn đã truy cập trước khi truy cập trang web The Training Exchange, loại và phiên bản của trình duyệt web và bất kỳ cụm từ tìm kiếm nào mà bạn đã nhập trên trang web hoặc trang web liên kết.
Thông tin bảo mật: Thông tin này bao gồm tên người dùng, mật khẩu, câu hỏi bảo mật và câu trả lời cho các câu hỏi bảo mật.
Nếu không được thu thập thông tin này, chúng tôi không thể cung cấp nội dung đào tạo cho bạn và cung cấp hỗ trợ kỹ thuật.
IV. Mục đích của việc xử lý thông tin cá nhân của tôi là gì?
Westlake và công ty con là chủ sử dụng lao động của bạn sẽ thu thập và xử lý tất cả các thông tin cá nhân được xác định ở trên chỉ trong phạm vi cần thiết cho các mục đích sau:
(a) Cung cấp khóa đào tạo trực tuyến: Westlake và tổ chức tuyển dụng của bạn có thể sử dụng Thông tin về công việc và Thông tin về học tập để cung cấp nội dung đào tạo trực tuyến cho bạn và quản lý chương trình đạo tạo theo các nhân hoặc nhóm.
(b) Báo cáo nội bộ: Westlake và tổ chức tuyển dụng có thể sử dụng Thông tin về công việc và Thông tin về học tập để tạo báo cáo về trạng thái của nội dung đào tạo được cung cấp cho nhân viên, chẳng hạn như ai cần hoặc đã hoàn thành khóa đào tạo và để ghi lại lịch sử đào tạo của nhân viên.
(c) Hỗ trợ kỹ thuật: Thông tin HTTP và thông tin bảo mật có thể được nhà cung cấp The Training Exchange sử dụng để giúp chẩn đoán các sự cố về ứng dụng hoặc máy chủ và để quản trị nền tảng đào tạo. Thông tin như vậy cũng có thể được sử dụng để thu thập thông tin nhân khẩu học chung, chẳng hạn như quốc gia xuất xứ và nhà cung cấp dịch vụ internet.
V. Thông tin cá nhân của tôi được lưu trữ bao lâu?
Thông tin cá nhân trong hệ thống Training Exchange sẽ được lưu trữ chừng nào cần thiết để đạt được các mục đích nêu trên hoặc cần thiết để tuân thủ mọi yêu cầu báo cáo hoặc giữ lại hợp pháp.
VI. Điều gì bắt buộc chúng tôi phải thu nhận và xử lý thông tin cá nhân?
Việc xử lý cho mục đích được nêu trong Phần V ở trên (1) là cần thiết để tuân thủ các nghĩa vụ pháp lý cụ thể liên quan đến mọi khía cạnh trong mối quan hệ công việc hoặc để tuân thủ luật pháp về an ninh xã hội, vệ sinh, an toàn nghệ nghiệp, môi trường, thuế, quyền của thành viên công đoàn, mối quan hệ trong công việc, bảo vệ sức khỏe, trật tự và an toàn công cộng và luật chứng khoán Hoa Kỳ mà Westlake và công ty con của Westlake phải tuân theo; và (2) cần thiết vì lợi ích hợp pháp của Westlake để đào tạo nhân viên về các chính sách và quy định phù hợp của công ty áp dụng cho nhân viên.
VII. Ai sẽ tiếp nhận thông tin cá nhân của tôi?
1. Cornerstone với vai trò là đơn vị xử lý
Thông tin cá nhân bạn cung cấp sẽ được lưu trữ trong cơ sở dữ liệu được đặt trên các máy chủ tại Hoa Kỳ, do Cornerstone OnDemand Inc. quản lý. Cornerstone OnDemand Inc., có trụ sở tại 115 Perimeter Center Place, Suite 460, Atlanta, Georgia 30346, là đơn vị xử lý dữ liệu thông tin cá nhân trên The Training Exchange. Đơn vị này đã ký kết các cam kết hợp đồng với Westlake để bảo mật thông tin bạn cung cấp theo luật hiện hành và để đảm bảo rằng đơn vị sẽ thay mặt chúng tôi chỉ xử lý thông tin cá nhân trên The Training Exchange tuân theo hướng dẫn chúng tôi đưa ra. Cornerstone cam kết duy trì các biện pháp nghiêm ngặt về bảo mật và quyền riêng tư, bao gồm những biện pháp liên quan đến thông báo, sự chấp thuận, truyền thông tin cá nhân, bảo mật, tính toàn vẹn của dữ liệu, khả năng truy cập và thực thi. Nếu thích hợp để thực hiện nghĩa vụ theo hợp đồng với Westlake, một số thành viên thuộc bộ phận CNTT của Cornerstone có thể nhận thông tin cá nhân trong The Training Exchange để họ có thể hỗ trợ về cơ sở dữ liệu quan trọng cho ứng dụng trực tuyến này.
2. Các bên khác
Các nhân viên có liên quan của Westlake và, nếu có thể, Người dùng liên kết hoặc Đơn vị kiểm soát liên kết liên quan (xem Phần I và Error! Reference source not found. ở trên), bao gồm các thành viên ban quản trị, đại diện của Bộ phận nhân sự, Sức khỏe, An toàn & Môi trường, Công nghệ thông tin (CNTT), Phòng pháp chế và các cố vấn pháp lý bên ngoài của Westlake hoặc các công ty con của Westlake cũng có thể nhận được thông tin cá nhân trên The Training Exchange. VIII. Thông tin cá nhân của tôi được chuyển đi đâu?
Cornerstone sẽ quản lý và xử lý thông tin cá nhân trong The Training Exchange tại Hoa Kỳ. Trong trường hợp cần thiết để Westlake thực hiện bất kỳ mục đích nào được mô tả trong Phần V, thông tin cá nhân sẽ được chuyển cho cá nhân liên quan thuộc công ty con của Westlake tại Hoa Kỳ, Westlake Management Services, Inc., nhân viên liên quan được tuyển dụng tại công ty con của Westlake chịu trách nhiệm khởi tạo, yêu cầu hoặc điều phối khóa đào tạo hoặc nhân viên liên quan được tuyển dụng tại công ty con của Westlake tuyển dụng bạn, trong phạm vi được phép theo luật áp dụng. IX. Thông tin cá nhân của tôi có được bảo vệ không?
Westlake và bất kỳ Người dùng liên kết hoặc Đơn vị kiểm soát liên kết sẽ thực hiện các biện pháp an toàn cần thiết và hợp lý để ngăn chặn thông tin cá nhân của bạn không bị đánh cắp, thay đổi, hư hỏng, phá hủy hoặc tiết lộ.
X. Tôi có quyền gì?
Dữ liệu của bạn sẽ được xử lý hợp pháp, công bằng và minh bạch. Theo nghĩa vụ của chúng tôi theo quy định của luật pháp hiện hành, bạn có thể thực hiện các quyền sau:
Quyền truy cập: Bạn có quyền nhận thông báo xác nhận từ chúng tôi về việc thông tin cá nhân của bạn có được xử lý hay không, hoặc trong một số khu vực pháp lý nhất định, bạn có thể yêu cầu sao chép thông tin cá nhân đó. The Training Exchange 的使用者

I. 誰會獲得及處理我的個人資訊？

III. 處理的個人資訊有哪些？
出於管理線上培訓之目的，以下個人資訊將在 The Training Exchange 進行處理：
就業資訊：包括您在相關子公司的工作資訊，包括就職日期、在職或休假狀態、電子郵件、就業狀態、工作分類、職位、部門、業務單位、主管姓名及職位、工作地點及地址、任職時間及作為雇主的實體。
學習資訊： 包括您感興趣的培訓主題、分配給您的培訓課程、您完成培訓的日期及時間、完成培訓的狀態、您的時區、無論您是平台準備的培訓播放清單的「創作者」或「關注者」、平台為您推薦的培訓選擇、您的偏好語言及您的培訓紀錄。
HTTP 資訊：包括您存取培訓工具的 IP 位址及網域名稱、您存取 The Training Exchange 網站之前存取的網站（引用 URL）、網路瀏覽器的類型及版本及您在網站或推薦網站輸入的搜尋詞彙。
安全資訊：包括您的使用者名稱、密碼、安全問題及安全問題的答案。
如果我們無法收集此類資訊，我們可能無法向您提供培訓內容與技術支援。
IV. 我的個人資訊是基於什麼用途而處理？
Westlake 與您雇主的子公司僅在下列目的必要範圍內獲得及處理上述所有個人資訊：
(a) 提供線上培訓： Westlake 與您的雇主實體可能使用就業資訊及學習資訊向您提供線上培訓內容並管理團體或個人培訓計畫。

V. 我的個人資訊會儲存多久？
The Training Exchange 的個人資訊將在達到上述目的所必要時間內進行儲存，或者在遵守關於報告或保留此類資訊的任何法律要求的必要時間內進行儲存。
VI. 我們必須獲得及處理個人資訊的原因為何？

VII. 誰會收到我的個人資訊？
1. Cornerstone 作為處理器
您提供的個人資訊將儲存在位於美國 Cornerstone OnDemand Inc. 託管之伺服器的資料庫。Cornerstone OnDemand Inc. 地址位於 115 Perimeter Center Place, Suite 460, Atlanta, Georgia 30346，為 The Training Exchange 個人資訊的資料處理者，已與 Westlake 簽訂合約承諾，遵循適用法律保護您提供的資訊，確保僅代表我們並遵守我們的指示處理 The Training Exchange 的個人資訊。 Cornerstone 致力於維護最嚴格的隱私與安全實務，包括注意事項、同意、移轉個人資訊、安全性、資料完整性、存取和執行方面的實務。 如果與履行對 Westlake 的合約義務有關，Cornerstone 的資訊技術人員可能會收到 The Training Exchange 的個人資訊，讓他們得以執行對這個線上應用程式重要的資料庫支援。

IX. 我的個人資訊是否受到保護？
Westlake 以及任何適用的共同使用者或共同控制者，將會採取必要合理之安全措施，避免您的個人資訊遭到竊取、竄改、損害、銷毀或揭露。
X. 我有哪些權利？
您的資料會以合法、誠實且透明的方式處理。 依適用法律就我們義務的規定，您可行使以下權利：
使用權： 您有權利就自己的個人資訊是否正在處理中，尋求我們的確認，或者，在某些管轄區，您可以提出複製此等個人資訊的請求。 如果您的個人資訊正在處理中，您有權取得此等個人資訊，並且收到某些資訊，例如處理目的、涉及之個人資訊的類別，以及個人資訊過去或未來揭露的接受者。
糾正（矯正）的權利： 如果我們持有的關於您的個人資訊不正確或不完整，您有權糾正。 如果您有糾正資訊的權利，而且如果我們向他人透露您的個人資訊，我們就會在可能的情況下，讓他們得知矯正一事。 如果您就我們透露您就個人資訊的對象詢問我們，以直接與對方聯繫，我們也會在可能且合法的情況下告知您。
清除的權利： 您有權在某些情況下，讓我們不得無故拖延即清除您的個人資訊，例如我們不再需要出於處理或蒐集個人資訊的初始目的來保留個人資訊，或是如果您撤回同意，而且處理一事不具其他法律依據。 如果基於某些理由必須處理，則清除的權利便不適用，例如如果遵照法律義務，或是為了法律索賠之證明、行使或抗辯必須處理。 如果您有清除的權利，而且如果我們向他人透露您的個人資訊，我們就會在可能的情況下，讓他們得知清除一事。如果您就我們透露您就個人資訊的對象詢問我們，以直接與對方聯繫，我們也會在可能且合法的情況下告知您。
限制處理的權利： 您可以在某些情況下要求我們限制處理您的個人資訊，例如您對個人資訊的正確性提出質疑。 限制意味著，日後處理時不得使用您的儲存個人資訊， 如果您有限制的權利，就只會在獲得您的同意，或是為了法律索賠之證明、行使或抗辯，或是為了保護他人權利，或是為了適用管轄地相關重要公眾利益之故時，才會處理個人資訊。 如果您已取得限制處理的權利，我們將在處理限制解除前通知您，而且限制的持續時間將能夠讓我們確認個人資訊的正確性。 如果您有限制的權利，而且如果我們已向他人透露您的個人資訊，我們就會在可能的情況下，讓他們得知限制一事。 如果您就我們透露您就個人資訊的對象詢問我們，以直接與對方聯繫，我們也會在可能且合法的情況下告知您。

不接受自動化決策與資料剖析的權利： 如果基於自動處理（包括資料剖析）做出的決策會對您產生法律效力或類似的嚴重影響，您有權不接受該決策，除非此等資料剖析是您和我們簽署或履行合約時的必要條件。 我們無意就處理您的提報使用自動化決策。

III. 将处理哪些个人信息？
